Homejam, Inc.(“Homejam”, “we”, “us” and terms of similar meaning) respects your privacy and is committed to protecting it by complying with the terms outlined in thisHomejamPrivacy Policy (“Privacy Policy”). This Privacy Policy describes how we collect, use, share and protect the personal information of ourusers(“you”) onthe Homejamplatform (located at https://www.myhomejam.com)(the “Services”).

1. Personal Information We Collect

Directly.We collect and use your personal information to provide you with a secure and safe experience when accessing and using the Services.Our collection and use of your personal information will be limited to that which is necessary to provide you with a tailored experience. For that reason, through the course of using the Services, you may be prompted to provide us with personal information, which may include your first name, last name, association membership, email,address, phone number, password,authentication information and payment information.

Third-Parties.We may collect your personal information from third-parties that provide it to us. These third-parties may include associations, companies, or other organizations that you are a member or employee of that sponsor, coordinate or host events through the Services that are provided to you.

How Your Information is Collected.We collect personal information form you when you sign up for a user account, communicate with others through the Services and when you update your account’s information. We may collect your personal information from other users on the Services, referrals or through third-party service providers that integrate with the Services.

Referrals.We may provide you with the opportunity to refer our Services to friends and family by sharing a referral code or their personal information.Homejam does not collect any personal information when you share a referral code but may collect and retain the personal information of others if it provided to us. Any personal information obtained without an individual’s consent will be deleted in a commercially reasonable time after being received. If your referral accepts the referral offer, you may be notified by us.If you accept a referral offer, we may store your personal information in order to provide you with the benefits of the referral offer. We will collect and retain your information in accordance with the remainder of this Privacy Policy. We may use information derived from the referral code or personal information to make adjustments to your account that reflect the terms of the referral code’s offer.

User Reviews.You may be provided with surveys through your use of the Services that request feedback on your experience with the Services,contractors or our commercial partners.The information from these surveys may be linked with your user account.

2. Information We Collect Through Cookies and Other Automatic Data Collection Technologies

Indirectly.As you use the Services, we may use cookies or other automatic data collection technologies to collect personal information and information about your equipment, browsing actions, and patterns from the use of the Services.Homejam uses reputable automated technologies and third-party service providers to perform these functions.Any information that is derived through our use of cookies and other tracking technologies is used to provide us with analytics, Site, Application and other Services improvements.Information collected may include:

(i) Affiliated Companies: We may share your information with our subsidiaries, parent company and other affiliated entitiesto effectively provide you with the Services.

(iii) Payment Processors:Users may be able to submit credit card or other payment information into the Services to pay for a requested project.Homejam utilizes third-party payment processerstofacilitate payments. We do not receive nor store any payment information on our servers. All payment transactions are encrypted when communicated through our third-party payment processor.

(iv) Storage Providers:We may process, store, and transfer your personal information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as privacy laws in the United States of America. Whenever we engage a service provider, we require that its privacy and security standards adhere to this policy and applicable United States of America privacy legislation.

(v) Commercial Partners: We may share your information or anonymized aggregated data derived from your information and the information of others with some of our commercial partners. We may allow merchandise and other entertainment-relatedvendors to incorporate their offerings into the Services.If you provide us with your information and request for your information to be shared with a commercial partner in order to access their offerings, we may provide the relevant commercial partner with your information as requested.

(vi) Legal Requirements:We may share your information tocomply with any court order, law, or legal process, including to respond to any government or regulatory request, under applicable law.

(vii) Business Transactions: Homejam reserves the right to share your information in connection with any proposed or realized merger, divestiture, consolidation,restructuring, purchase, saleor any other type of business combination that requires its disclosure.

6. Security of Collected Information

Homejam uses physical, electronic, technical and administrative safeguards designed to secure your personal information from accidental loss and unauthorized access, use, modification, and disclosure. We storeall of the information you provide to us onsecure servers. Although we implement measures to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Services. Any transmission of personal information to the Services is done is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on the Services.

The safety and security of your personal information also dependson you. User accounts on the Services are password-protected, and if you have a user account are solely responsible for keeping your password confidential. We ask that you (a) do not share your password with anyone; (b) do not post your password in any public areas online (d)do not use your password on any public devices that you might forget to log-out of.

7. Data Retention

(a) Retention Policy.To improve the Services, we may aggregate information from users after removing information that can allow them to be identified. You acknowledge and agree that we may use anonymized personal information for legitimate business purposes that cannot be associated with you. We reserve the right to use such anonymized information without further notice.

We may periodically de-identify or delete personal information from inactive user accounts and unnecessary information that is flagged by our administrators. With the exception of aggregated or anonymized data, we will delete unnecessary or unused personal informational after two (2) years of inactivity on the Services.

(b) Termination Account.If your account on the Services is terminated, we may retain your personal information for a certain period of time (e.g., archive your personal information and retain any recordings made), which will be disclosed to you and performed in accordance with our practices under this Privacy Policy.

We will comply with your request unless it conflicts with our legal obligations oran established standard of practice. Please be aware that if you withdraw your consent, we may be unable to provide you with the Services.

(e) Transfers of Data. We and our affiliates and third-party service providersprimarily store data about you, on servers located and operated within the United States of America(the “U.S.”). If you reside or are located outside of the U.S., we may send and store your date to the U.S. in order to provide and operate the HomejamPlatform. Homejam undertakes to ensure an adequate level of protection of the personal data transferred outside the European Economic Area, either by us, our affiliates, and/or third-party service providers, in accordance with applicable legislation, in particular via the signature of the standard contractual clauses approved by the European Commission or the Privacy Shield certification.

9. Opting-Out of Communications

We may send periodic marketing, promotional or informational emails to you in accordance with your communication preferences. These may include emails for future events and products.You may opt out of such communications at any time by following the opt-out instructions contained in the email or by contacting us at the email below.

If your personal information is provided to us in connection with an event organized by a third-party, we will only contact you with the personal information provided if it is in accordance with the privacy practices of the third-party.

10. Children’s Privacy

The Services are not intended for children underthirteen (13) years of age.We do not knowingly collect personal information from children under thirteen (13) years of age.If you are under eighteen (18) years of age, we must receive your parent or legal guardian’s consent before we can collect, use or disclose your information on the Services.If we learn we have collected or received personal information from a child without verification of parental consent, we will delete that information. These disclosures are for residents of California who access and use the Homejam Platform as private individuals. You may authorize an agent to submit requests under this policy on your behalf. However, we will require written proof of the agent’s authority to do so and verify your identity.

1. Categories of Personal Information We Collect and Use

If you are a resident of California, the following are the categories of information we collect from you:

• Identifiers.Name, account name, address, IP address, email address, and identifier assigned to your User Account.

• Customer Records.

a. Guests: name, email, address, bank account, credit cardanddebit card number.

b. Event and Concert Organizers:Name, signature, address, telephone number, bank account number, credit or debit card number.

• Demographic Information.Race, religion, age, and other personal information that qualify as protected classification characteristics under other pre-existing California or federal laws.

• Analytics and Advertising. Purchases and engagement with the Homejam Platform.

• Internet Activity. Browsing history, browser type, search history,browser language and information regarding your interaction with our Service collected automatically.

• Geolocation Data. Information that location enabled servicescollect through Wi-Fi and GPS.

• Inferences. Information that can be used to create a profile about your interests and preferences.

We collect and use these categories of personal information for the business purposes described inour Privacy Policy’s How We Use Your Information section, in order to provide and manage our Services. We may disclose information in the following categories with our partners to assist with our operations and provide the Services: (a) Identifiers, (b) Customer Records, (c) Demographic Information, (d) Geolocation Data, and (e) Inferences.

2. Right to Know

If you are a California resident and use the Homejam Platform as a private individual, you may have a right to receive a yearly accounting of: a. Information identifying each third-party company to whom we may have disclosed, within the past year, personal information pertaining to you for our own direct marketing purposes;

b. A description of the categories of personal information disclosed;

c. the right to know more about personal information that we have collected, disclosed, or sold, including:

i. The categories of personal information that we have collected or shared about you in the preceding 12 months,

ii. The categories of sources from which we have collected that information in the preceding 12 months,

iii. The commercial or business reason(s) we have collected or shared that information,

iv. The categories of third-parties with whom we have shared or to whom we have sold that information in the preceding 12 months, and

v. Pursuant to a verifiable request, the specific pieces of information that we have collected about you. Depending on the nature of your request, we may need additional information to verify your identity.

Homejam does not sell information as the term “sell” is traditionally understood. However, to the extent “sale” under the CCPA is interpreted to include advertising technology activities, we will comply with applicable law as to such activity.

3. Right to Delete

You also have the right to delete the personal information we have collected from you. However, this is not an absolute right and Homejam may have legal grounds for keeping such data.To exercise any of these rights, please submit a request at privacy@myhomejam.com. In the request, please specify which right you are seeking to exercise and the scope of the request. We will confirm receipt of your request within ten(10) days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.

4. Shine the Light

If you are a resident of California, you may request (i)a list of the categories of personal information disclosed by us to third-parties during the immediately preceding calendar year for those third-parties’ own direct marketing purposes, and (ii) a list of the categories of third-parties to whom we disclosed such information. We may require additional information from you to allow us to verify your identity. This may only be requested once during any calendar year.

If you choose to exercise any of the rights listed above, you have the right to non-discriminatory treatment by Homejam.


In light of theSchrems II decision by the European Court of Justice on July 16, 2020 ((EU) 2016/1250)), Homejam no longer relies on the EU-US Privacy Shield to lawfully transfer personal data from EEA countries to the United States, although we remain committed to the Privacy Shield principles("Principles") when processing personal data.Homejam has subscribed to and will adhere to the EU-U.S. and Swiss-U.S. Privacy Shield frameworks by adopting and implementing the Principles. We may obtain and process your personal information as a data controller through www.myhomejam.com, or in connection with our customer, partner, and vendor relationships. We may also obtain and process your personal information as an agent on behalf of third-parties. We provide you notice through our Privacy Policy andwill provide you choice as to the types of personal information you provide us while using the Homejam Platform.

This Privacy Shield Notice ("Notice") describes our standards and procedures for handling personal information transferred from the European Economic Area ("EEA") and Switzerland to the U.S. in accordance with Homejam’s obligations under the EU-U.S. and Swiss-U.S. Privacy Shield frameworks.Homejam is committed to comply with the EU-US Privacy Shield (as set forth by the U.S. Department of Commerce) regarding the collection, use, and retention of personal information from European Union member countries.Homejam makes reasonable efforts toadhere to each of the Principles.If there is any conflict between the terms in this Privacy Policy and the Principles, the Principles shall govern.

Privacy Shield Principles

• Accountability for Transfers. If any third-party service providerthat processespersonal information on Homejam’s behalf does so in a manner inconsistent with the Principles,Homejam will remain responsible and liable unless it can prove that it is not responsible for the event giving rise to the damage.

• Right of Access.You have a legal right to request a copy of the personal information that we have about you. You also have a right to correct, amend or delete such personal information where it is inaccurate or has been processed in violation of the Principles.

• Data Integrity and Limits of Purposes. Any personal information we receive may be used by Homejam for the purposes indicated in ourHomejamPrivacy Policy or as otherwise notified to you. We will not process personal information in a way that is incompatible with these purposes unless subsequently authorized by you.

• Enforcement. Homejamis subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).
